Terms of Sale.
A plain-English guide to what applies when you buy a firearm, component, or accessory from Second of Ten. We’ve written it so you can read it once and know what to expect — what we’ll do, what you’re agreeing to, and what happens if something goes sideways.
This is a customer-friendly summary of our full Terms and Conditions of Sale. When you place an order, the full document is what legally governs the sale. If anything on this page and the full document conflict, the full document controls.
When You Place an Order
Our website listings, catalog pages, and quotes are an invitation for you to place an order — they aren’t a binding offer from us. Your order becomes a binding sale only when we send you a written order acknowledgment. Charging your card or receiving your funds doesn’t, by itself, mean we’ve accepted the order.
Prices, photos, specs, and stock levels can change without notice, and typos happen. If we spot a pricing or description error after you order, we’ll tell you and give you the choice to proceed at the corrected price or get a full refund for that item.
We can decline or cancel an order at any time for lawful reasons — including fraud concerns, missing FFL paperwork, suspected straw purchases, export-control issues, or anything else we identify before shipment. If we cancel, we refund what you paid. That’s the full remedy for a cancelled order.
↑ Back to contentsWho Can Buy
By placing an order, you confirm all of the following are true at the time of order and again at delivery:
- You’re old enough to buy the product under federal, state, and local law (generally 18+ for long guns and rifle components, 21+ for handguns and handgun components).
- You’re a U.S. citizen or lawfully admitted resident, and you’re not legally barred from owning firearms or ammunition.
- You haven’t been convicted of a felony or any crime carrying more than a year in prison, and you’re not under indictment for one.
- You’re not a fugitive, an unlawful drug user, subject to a qualifying restraining order, or otherwise a prohibited person under federal law.
- You’re buying for your own lawful use (or for lawful resale through licensed channels) — not for someone who can’t legally own a firearm.
Lying about any of this — to us or on ATF Form 4473 — is a federal crime. We may refuse or cancel any order if we suspect a misrepresentation.
How Firearms Ship
Federal law doesn’t let us ship firearms directly to you. Every firearm goes through a licensed FFL dealer in your state of lawful residence. Here’s how it works:
- You find an FFL dealer who’s willing to receive the firearm and complete the transfer for you.
- That dealer sends us a current, signed copy of their license before we ship.
- You pay the dealer’s transfer fee directly to them — that’s their fee, not ours, and it varies by dealer.
- You complete ATF Form 4473 at the dealer, pass any required background check, and meet any state or local requirements.
- You inspect the firearm at the dealer before signing Form 4473. Once you sign and take possession, the firearm is legally yours.
If your transfer doesn’t happen — your dealer refuses, your background check is denied, or you don’t pick it up within 30 days — you’re responsible for arranging return shipping at your expense. We may also charge a restocking fee of up to 20%.
Components that aren’t classified as firearms (handguards, grips, optics, most triggers, most gas systems, and similar parts) can ship directly to you where lawful.
↑ Back to contentsNFA Items
Suppressors, short-barreled rifles, short-barreled shotguns, and other items regulated under the National Firearms Act work differently. If you’re ordering an NFA item, here’s what to know:
- Transfer goes through a licensed Class 03 SOT dealer on ATF Form 3 (dealer-to-dealer) or Form 4 (to you).
- You pay the federal transfer tax — typically $200 — through the receiving dealer.
- State and local NFA laws vary. You’re responsible for confirming the item is legal where you live.
- ATF processing takes months, sometimes more than a year. We can’t speed it up and we don’t refund based on ATF processing time.
- Once we’ve initiated a Form 3 or shipped the item to your dealer, cancellations carry a restocking fee up to 25%, plus any non-refundable tax and dealer fees.
- We don’t ship NFA items into any state or jurisdiction where they’re not legal for you to possess.
Pricing, Taxes, and Payment
Prices are in U.S. dollars and don’t include shipping, handling, insurance, FFL transfer fees, or taxes. You’re responsible for any sales, use, excise, or similar taxes that apply to your purchase. Where we’re required to collect sales tax, we add it to your invoice.
Payment is due at the time of order unless we’ve extended you written credit terms. Late payments accrue interest at the lesser of 1.5% per month or the maximum allowed by law. If we have to send an account to collections, you’re responsible for collection costs and reasonable attorney’s fees.
↑ Back to contentsShipping, Delivery, and Risk
Shipping dates and lead times are estimates, not promises. We’re not on the hook for delays caused by carriers, FFL dealers, government agencies, or supply-chain issues. Time is not of the essence.
Risk of loss passes to you when we hand the package to the carrier. If your shipment is lost or damaged in transit, the claim is between you and the carrier — we’ll cooperate, but we’re not the claimant. Insurance and declared value are your responsibility.
For firearms shipped to your FFL, the dealer holds the package as your agent. Title transfers to you personally when you complete Form 4473 and any state or local procedures.
↑ Back to contentsReturns and Refunds
Once you sign Form 4473 and take possession of a firearm, it’s legally a used firearm and we can’t take it back for refund.
Inspect the firearm at your FFL before signing. If something is wrong — visible damage, wrong model, wrong caliber, wrong serial number — flag it before you sign. After that, the only remedy is the limited warranty.
For non-regulated components in new, unused, unmounted, unfired, uninstalled condition in original packaging:
- You can return them within 30 days of delivery for a refund.
- We charge a restocking fee of up to 20% and outbound shipping isn’t refundable.
- Return shipping is at your expense.
Custom, engraved, special-order, or built-to-order products are non-cancellable and non-returnable once we’ve started production, except for confirmed manufacturing defects covered by the warranty. Ammunition, mounted optics, loaded magazines, and any item showing use can’t be returned.
All returns require an RMA (Return Merchandise Authorization) number from us before you ship anything. Unauthorized returns will be refused at the dock and sent back to you at your expense.
↑ Back to contentsWarranty in Brief
Our products are covered by a separate Limited Warranty & RMA Process document. The short version:
- Lifetime warranty on complete firearms, upper receivers, lower receivers, and rails — to the original retail purchaser only.
- Two years on components and accessories that aren’t “wear items” — triggers, bolt carrier groups, gas blocks, buffers, muzzle devices, handguards.
- One year on wear items — springs, pins, barrels, gas tubes, extractors, ejectors, detents, magazines, finishes.
The warranty is not transferable. If you sell or gift the product, the warranty ends. Commercial use (range rentals, training-academy fleets, armorer-school inventories) is excluded.
Things that void the warranty: reloaded or improper ammunition, modifications by anyone other than us or our authorized service center, removed or defaced serial numbers, criminal misuse, and damage from neglect, accidents, or extreme conditions. The full list is in the warranty document.
Third-party components are governed by their manufacturer’s published warranty. Where that warranty extends beyond ours, we will act as the original owner’s agent in presenting and pursuing the claim. See who warrants what →
State and Local Law
Firearms laws vary widely between states, counties, and cities — and they change often. Magazine capacity limits, “assault weapon” features, barrel length rules, suppressor restrictions, and permit requirements aren’t the same everywhere.
It’s your responsibility to know what’s legal where you live, transport, and use the product. We don’t give legal advice. If we list a product as “compliant” or “restricted” for a particular state, that’s informational, not a legal opinion. We may refuse an order or configure a product to a compliant spec based on the ship-to address.
We do not ship AR-15 upper receivers, conversion kits or barrel assemblies to the restricted states and localities listed in our FAQ.
Safety and Risk
Firearms are inherently dangerous. Improper handling, storage, modification, or use can kill or seriously injure you or others. By buying a Second of Ten product, you’re taking on the risk that comes with owning one.
You agree to
- Read and follow the owner’s manual before you use the product.
- Always treat every firearm as loaded; never point the muzzle at anything you’re not willing to destroy; keep your finger off the trigger until you’re on target and ready to fire; and always know your target and what’s behind it.
- Use only factory, SAAMI/CIP-spec ammunition in the correct chambering.
- Wear eye and ear protection.
- Store firearms securely, separate from ammunition, and out of reach of children and prohibited persons.
- Get qualified instruction before you shoot.
No firearm and no engineering standard can eliminate the risk of mechanical failure, ammunition failure, or user error.
↑ Back to contentsDisputes
If we ever disagree about something and can’t work it out directly, here’s how we resolve it:
- Florida law applies.
- Disputes go to binding arbitration through JAMS in Stuart, Florida — or in your home county, your choice. The Federal Arbitration Act governs.
- Both sides waive the right to a jury trial and the right to participate in a class action. Arbitration is one-on-one only.
- Small-claims court is still available for individual claims that fit there.
- You can opt out of arbitration by sending us written notice within 30 days of first agreeing to these terms.
Our maximum total liability for any claim related to a product is the amount you actually paid us for that specific product. We aren’t liable for indirect, incidental, or consequential damages — like lost profits or loss of use — to the extent the law allows us to exclude them.
↑ Back to contentsExports
Our products are subject to U.S. export-control laws administered by the Department of Commerce, plus economic sanctions administered by OFAC. You agree not to export, re-export, or transfer any product or technical information outside the United States — or to any sanctioned person, country, or end use — without the proper U.S. government authorization. You also confirm you’re not on any U.S. government denied-parties or sanctions list.
↑ Back to contentsPrivacy and Communications
We collect the information we need to fulfill your order, comply with firearms law, handle warranty claims, and communicate with you. Our full Privacy Policy explains exactly what we collect, how we use it, and your rights. Some information has to be disclosed to ATF, state regulators, or law enforcement when the law requires it.
By ordering, you agree we can communicate with you electronically — order confirmations, shipping notices, safety and recall notices, invoices, and updates to these terms. Electronic communications satisfy any legal requirement for written notice.
↑ Back to contentsChanges to These Terms
We may update these terms from time to time. The version in effect when you place your order is the version that governs your order. If you keep buying after we update the terms, you’re accepting the updated version.
No employee, dealer, or representative can change these terms verbally or commit us to anything different in writing without authorization from a Second of Ten officer.
