Terms of Use.
The rules for using www.secondoften.com — who the site is for, what you can do with what’s on it, and what happens if something goes wrong. Buying, privacy, and warranty are covered by their own documents, linked throughout.
This page is a plain-English summary of the website terms in our full Website Legal Terms of Use & Privacy Policy. The full document is what legally governs your use of the site. If anything on this page and the full document conflict, the full document controls. Read the full document →
What These Terms Cover
These Terms of Use govern your use of www.secondoften.com, our sub-domains, and any associated web or mobile applications we operate — together, “the site.”
They sit alongside our other posted terms. Our Privacy Policy covers what we do with your information. Our Terms and Conditions of Sale cover buying something. Our Limited Warranty & RMA Process covers warranty claims. Where one of those documents speaks to a subject, it governs that subject — these Terms of Use cover using the site itself.
↑ Back to contentsDefinitions
A few words are used in a specific way throughout this page:
- We, us, our
- Second of Ten LLC.
- Visitor
- Anyone browsing the site without an account.
- Account holder
- Anyone who has registered an account with us.
- You, user
- Either of the above — anyone using the site in any way.
- Content
- Everything we publish on the site: text, specifications, drawings, photographs, video, audio, data, guides, and the software that runs it.
- Your content
- Anything you submit — reviews, questions, photos, video, or messages.
By Using the Site, You Agree to These Rules
Browsing our website, creating an account, submitting information, or placing an order means you accept these rules and our Privacy Policy. If you don’t agree with any of this, the simplest answer is to not use the site.
If you’re using the site for a business or other organization, you’re confirming you have the authority to bind that organization to these terms.
↑ Back to contentsYou Need to Be Old Enough
The site is for users 18 or older. Pages about firearms, components, and regulated accessories are limited to users 21 or older — or whatever the legal age is in your area to view or buy the underlying product.
You also confirm you’re not legally barred from owning firearms under federal or state law. We may verify age or eligibility at any time. Lying about your age or eligibility is a serious breach of these terms.
↑ Back to contentsYour Account
If you create an account, give us accurate information and keep it current. Keep your password to yourself. You’re responsible for everything that happens under your account, whether or not you authorized it. Tell us right away if someone uses your account without your permission.
We can refuse, suspend, or close an account at any time if we think it’s been used to break these rules, threaten the site, or do something unlawful.
↑ Back to contentsWhat You Can Do With Our Content
You can browse, read, view, and (if you’re a customer) purchase products. That’s the license we’re giving you, and it’s personal, non-exclusive, and revocable. You can’t:
- Copy, republish, or distribute our content beyond personal use.
- Modify or create derivative works from our content.
- Use any of our content to train AI or machine-learning models.
- Frame, mirror, or deep-link to the site without permission.
- Run scrapers, bots, or other automated tools against the site.
What You Can’t Do — Period
Don’t use our site to:
- Break federal, state, local, tribal, or foreign law — including firearms, export-control, sanctions, and anti-terrorism laws.
- Buy for someone who can’t legally own a firearm. This is called a straw purchase. It’s a federal crime, not just a violation of our terms.
- Pretend to be someone else or fake your identity.
- Send malware, run denial-of-service attacks, or probe our systems for vulnerabilities.
- Harvest other users’ personal information or use contact info from the site for unsolicited marketing.
- Reverse engineer, decompile, or try to figure out our source code (except where the law specifically allows it).
- Post content that’s unlawful, fraudulent, defamatory, obscene, harassing, threatening, or that infringes someone else’s rights.
- Plan, encourage, or commit any act of violence or unlawful force.
Stuff You Post (Reviews, Photos, Comments)
If you post a review, comment, photo, video, or anything else — that’s your content. You’re responsible for it. By posting, you confirm you own it (or have rights to use it) and you give us permission to use it for our business, including marketing, in any media now or later.
We don’t have to monitor what you post, but we can remove anything for any reason or no reason.
↑ Back to contentsOur Brand and Designs
Our website, logo, the “2ND” shield design, the “Bombproof by Design” tagline, our product names (including SOTM4), our drawings, our specifications, and everything else on the site are protected by copyright and trademark law. They belong to us or to people who let us use them.
The site also displays marks belonging to our suppliers and partners. Using our site gives you no license to use any mark on it — ours or anyone else’s — without written permission from whoever owns it.
Buying a product gives you the right to use that product — not to copy our brand or designs.
Product Information on the Site
We work hard to keep product info accurate, but typos, image errors, and spec changes happen. Don’t take our website specs as a contract. Colors and finishes can look different on different screens. Performance numbers (accuracy, velocity, group size) come from our test conditions; your results will vary.
↑ Back to contentsFirearms Ordering on the Site
If you order a firearm from us, our full Terms and Conditions of Sale govern the purchase. The short version: firearms ship to a licensed FFL dealer in your state of lawful residence, you complete Form 4473 there, and you handle compliance with state and local laws.
Buying is governed by a different document. Read the Terms and Conditions of Sale →
Exports
Our site runs out of the United States. Our products and the information about them are subject to U.S. export-control laws. Don’t export, transfer, or share our products or technical info outside the U.S. — or to anyone in a sanctioned country, or to anyone on a U.S. denied-parties list — without proper authorization.
By using the site, you confirm you’re not in a sanctioned country and not on any U.S. restricted-party list.
↑ Back to contentsWe’re Not Giving Legal Advice
Our articles, build guides, FAQ answers, and other content are for general information only. They aren’t legal advice, gunsmithing advice, or medical advice. Firearms laws vary widely and change often. For your specific situation, talk to a qualified attorney, a licensed gunsmith, or a certified instructor.
↑ Back to contentsOther People’s Sites
Our site might link to third-party sites — payment processors, FFL dealers, social media, etc. Those links are a convenience, not an endorsement, and linking to a site doesn’t make us affiliated with it or a sponsor of it. We don’t control them and aren’t responsible for what’s on them. Their terms and privacy policies apply, not ours — you visit them at your own risk.
↑ Back to contentsCopyright Complaints
If you think something on our site infringes your copyright, you can send a DMCA takedown notice to dave@secondoften.com or to our address at the end of this page.
The notice has to include the standard DMCA elements: your signature, a description of what’s been infringed, where the infringing material is on our site, your contact info, your good-faith belief statement, and your accuracy-and-authority statement under penalty of perjury.
Prefer a form? Use our DMCA notice form. It asks for every element a valid notice or counter-notice needs, and it reaches the same desk.
↑ Back to contentsWarranties (or the Lack of Them) for the Site
The site is provided “as is.” We work hard to keep it accurate and available, but we can’t guarantee it will be perfect, error-free, or always up. We’re not making any other warranty about the site itself — express, implied, or otherwise — to the extent the law lets us disclaim it.
Our maximum total liability for anything related to the site is the greater of what you paid us in the last 12 months, or $100. We’re not liable for indirect, incidental, or consequential damages — like lost profits, loss of use, or loss of data — to the extent the law allows us to exclude them.
This site liability cap is separate from product warranty. If you have a problem with a product you bought, the warranty (and the liability rules in our Terms and Conditions of Sale) apply, not these site terms.
You Cover Us If You Break the Rules
If you break these terms, post something that violates someone else’s rights, or violate the law, you’ll cover us — meaning you’ll defend, indemnify, and hold us harmless from third-party claims that come from what you did. We can take over the defense of any matter you’d otherwise have to indemnify us on, and you’ll cooperate with us if we do.
↑ Back to contentsHow We Enforce These Terms
We can look into complaints and reported violations of these terms, and take whatever action we reasonably think is warranted. That can include removing content, suspending or closing an account, blocking access to the site, and reporting suspected unlawful activity to law enforcement or regulators.
Where we’re legally required to, or where it’s necessary to investigate a violation or protect someone’s safety, we may disclose account details, contact information, usage history, posted material, and technical data such as IP addresses. What we can share, and when, is governed by our Privacy Policy.
Choosing not to enforce a rule once doesn’t mean we’ve given it up. We can still enforce it later.
↑ Back to contentsDisputes About the Site
If we ever disagree about something related to the site, here’s how we resolve it:
- Florida law applies, without regard to conflict-of-law principles.
- Disputes go to binding arbitration through JAMS in Stuart, Florida — or in your home county, your choice.
- Both sides waive jury trial and class actions. Arbitration is one-on-one only.
- Small-claims court is still an option for individual claims that fit there.
- Claims for injunctive relief to protect intellectual property are excluded from arbitration.
- You can opt out of arbitration by sending us written notice within 30 days of first agreeing to these terms.
Time Limit on Claims
Any claim you bring about the site or these Terms of Use has to be started within one year after the claim arises. After that it’s waived, to the extent the law allows a shorter period than it otherwise provides.
Some states don’t allow this kind of shortened period, and where that’s the case, this section doesn’t apply to you.
↑ Back to contentsIf Part of This Doesn’t Hold Up
If a court or arbitrator finds any part of these terms invalid or unenforceable, that part gets read as narrowly as needed to make it work — or dropped if it can’t be — and everything else stays in force.
You can’t transfer your rights or obligations under these terms to anyone else without our written consent. We can transfer ours in connection with a merger, acquisition, or sale of assets.
↑ Back to contentsThese Terms Are the Whole Agreement
These Terms of Use, together with our Privacy Policy and any other terms we post on the site, are the entire agreement between you and Second of Ten about your use of the site. They replace anything said or written before on that subject.
If anything published elsewhere on the site conflicts with these terms, these terms control. Nothing on a product page, in a blog post, or in a support article changes them.
↑ Back to contentsChanges to These Terms
We can update these terms anytime. We’ll post the updated version with a new effective date and, where the law requires, give you additional notice. If you keep using the site after the change, you’re accepting the new terms. If you don’t agree, stop using the site.
It’s worth checking back from time to time so you know what you’ve agreed to.
